Alexander Hamilton Handwritten Draft Stripping Benjamin Franklin's Son of Land in a Legal Battle Against His Rival Aaron Burr

Ten dollar founding father and infamous duel participant

 

ALEXANDER HAMILTON choice section of a legal brief containing 10 handwritten lines of notes. The section of Alexander Hamilton's handwriting is attached to an exceptional letter of provenance from Hamilton's son James Hamilton. James Hamilton has written on the cut legal brief "The above written is the/autograph of A Hamilton/a part of a Law brief/J.A.H". Over 50 words in Alexander Hamilton's flowing hand. 

 

This scrap is almost certainly from the 1786 legal battle in which Hamilton stripped Benjamin Franklin's loyalist son "Governor" William Franklin of land from an "Indian purchase" which the Governor had defaulted on. Franklin's claim to the land was defended by Aaron Burr who initially won an injunction on the sale of the land. Ultimately, Hamilton beat Burr in this legal duel stripping Franklin of the land and further fueling the feud that led to his demise.

"A misapprehension on his part would lead/to misapprehension in those who held/under him & continue the mistake"; "Till some Striking circumstance should/Set on foot an inquiry."; "Personal character of the Governor/might have been parsimonious"; "Others might have had claims/by Indian purchase which/it was necessary to elude--" A few additional handwritten words to the right section of the reverse including "the gover" "object" and "the". 

 

The letter of provenance from James Hamilton reads:
"March 28/67
Dear Sir,
In reply to your letter of the 24th I regret to say I have no letters of my Father which I can give for publication. His signatures have been all cut off and given away...I sent several to a gentleman in [location?] who is now enjoyed with the same enterprise I can give you scraps of my Fathers autograph to be cut from law briefs. They would be useful beyond showing his writing.

Overall piece measures 7"x5", snippet of Alexander Hamilton's handwriting measures 4.75"x2.25". Staining to the snippet of handwriting which is mounted by the top left corner to the letter from James Hamilton. One small tear to right margin, handwriting still remains remarkably bold and legible.
