Western lawman and pioneer, NEWTON EARP, best known as the older half-brother of infamous Tombstone Sheriff, WYATT EARP.  Earp twice signs a Writ of Replevin, as “N.J. Earp”, Constable (City Marshal) for the Township of Garden City, KS and featuring nearly two dozen other words in his hand.


A WRIT OF REPLEVIN is a prejudgment process ordering the seizure or attachment of alleged illegally taken or wrongfully held property to be held in the US Marshall’s custody, or another official under the order and supervision of the court.

The partially printed document is double-sided and concerned the case of Zelphia E. Handy, Plaintiff vs. John A. Stevens, Defendant “for wrongfully detaining the following described goods and chattels belonging to said plaintiff, to wit: a frame house one story consisting of a main part about 12 feet by 14 feet containing one room and having one outside door and two windows and an addition about five feet by 10 feet containing one outside door and two windows.”

 

Expected wear from age, use and handling, and some paper loss to sides and bottom ,as shown, else near fine and very legible. The sight size of the partial document is 3.5" x 8.5" 

 

NEWTON EARP lived in Missouri, Kansas, California, Nevada, Wyoming and other points west, where he kept a saloon, served as a farmer, carpenter, and contractor, and is even reported to have hunted buffalo. In 1870, Newton ran against his half-brother Wyatt in the constable's election in Lamar, Missouri: he lost. The following year, in 1871, Newton Earp relocated to Kansas where he served as first city marshal of Garden City, Kansas. Despite his accomplishments, Newton lived a relatively quiet life after leaving law enforcement, largely overshadowed by his more famous siblings.
